Court Appointment Process

1. Petition Filed

A family member, healthcare provider, social service agency, or other interested party files a petition with the court requesting appointment of a guardian or conservator.

2. Investigation & Evaluation

The court may order an investigation and medical evaluation to determine the individual's capacity and need for a fiduciary. Notice is provided to all interested parties.

Timeline: 30-60 days for investigation and evaluation

3. Court Hearing

A hearing is held where the court reviews evidence, hears testimony, and determines whether appointment is necessary and appropriate. The proposed ward has the right to attend and be represented by counsel.

4. Court Order & Letters

If the court determines appointment is necessary, it issues an order appointing the fiduciary and letters of guardianship or conservatorship authorizing the fiduciary to act.

5. Ongoing Oversight

The fiduciary must file regular reports with the court (typically annually) detailing the status, care, and finances of the protected person. The court maintains ongoing oversight of the guardianship or conservatorship.
